Supreme Court stays high court order to hold UP local body polls without OBC reservation | India News


NEW DELHI: The Supreme Court on Wednesday stayed the Allahabad high court order directing Uttar Pradesh government to hold urban local body polls without reservation for the OBCs.
The Lucknow bench of the Allahabad high court had on December 27 quashed a December 5 Uttar Pradesh government order proposing reservations for OBCs in civic elections. The high court had ordered the State Election Commission to “immediately” notify elections to the urban local bodies without OBC quotas.
The top court has given the State Backward Commission time till March 31 to file report on political backwardness of the OBCs for giving quota in local bodies.
To ensure that the administration of local bodies is not hampered, the apex court has allowed the state government to delegate powers after the end of their present terms.
However, administrators who will be delegated powers in the interim will not take major policy decisions, the top court said.
After the high court verdict, Uttar Pradesh chief minister Yogi Adityanath had announced that the local body elections will not be held in the state without providing quota to the OBCs.
The Samajwadi Party had also filed a Special Leave Petition (SLP) in the Supreme Court opposing the Allahabad high court’s Lucknow bench order to hold the urban body elections without reservations for Other Backward Classes.
