NEW DELHI: The Supreme Court on Wednesday turned down Samajwadi Party leader Azam Khan’s plea seeking transfer of trial against him and his son in the alleged fake birth certificate case outside Uttar Pradesh and allowed him to raise his grievances before the Allahabad high court.
Pressing for transfer of trial against him and his son to another state, Azam’s counsel and senior advocate Kapil Sibal told a bench of Chief Justice D Y Chandrachud and Justices S A Nazeer and P S Narasimha that his client was being persecuted by the UP government and he would not get justice if trials are held in the state.
The bench thereafter suggested that he can approach the HC if he wanted transfer of trial from Rampur district to another district within state. The bench said no case was made out to transfer the trial and allowed him to approach the high court to raise his grievances against the trial court proceedings and the order passed by it.
